"Official Giveaway Rules"
1. Drawing Eligibility. The Giveaway is open only to legal residents of the 50 United States who are 18 years old or older and are legally able to purchase, receive and/or possess a Ferret50 rifle chambered in .50BMG (.510DTC for residents of California). Sponsor, its affiliates, subsidiaries, employees, agents or other representatives of any kind and their immediate family members are not eligible to enter or win. Sponsor reserves the right to require the winner to complete an affidavit to confirm eligibility under these rules. VOID WHERE PROHIBITED OR RESTRICTED BY LAW
2. Official Sponsor. The official Sponsor of the Giveaway is David Moore DBA Spider Firearms.
3. Agreement to Official Rules. Your entry in this Giveaway constitutes your full and unconditional agreement to and acceptance of these Official Giveaway Rules. Entrants agree that the Sponsor of this Giveaway, social media websites, forums and messages board websites, and their respective affiliates, subsidiaries, employees, agents or other representatives of any kind shall not be responsible or liable for damages or losses of any kind arising out of or resulting from entry in this Giveaway, acceptance or use of a prize, or any other matter related to this Giveaway, including, without limitation, claims based on property damage, personal injury and/or death, publicity rights, defamation or invasion of privacy. All decisions related to, as well as all interpretation of, these Official Giveaway Rules by Sponsor will be final and binding. Winning a prize is contingent upon being compliant with these rules and fulfilling all other requirements as set forth herein.
4. Methods of Entry. The four methods of entering the Giveaway are as follows:
I. By sharing on social media or posting on message forums the 'Fabulous Ferret50 50cal Giveaway' or favorable review and/or pictures of the Ferret50 upper or rifle.
a) Post or share the "Giveaway Promotion" and/or favorable review of the Ferret50 on your social media page, including a link to www.ferret50.com, then email a link to your post to info@ferret50.com and you will be entered once for the Giveaway. Use "Giveaway Entry" as the subject heading of your email and include your name, address, telephone number and email address for the entry to be valid.
b) Post a new message of the "Giveaway Promotion" and/or favorable review of the Ferret50 on a firearms related (or otherwise related) message forum or board, including a link to www.ferret50.com, then email a link to your post to info@ferret50.com and you will be entered once into the Giveaway. Use "Giveaway Entry" as the subject heading of your email and include your name, address, telephone number and email address for the entry to be valid.
c) Post a comment to a message thread of the "Giveaway Promotion" or favorable review of the Ferret50 on a firearms related (or otherwise related) message forum or board, including a link to www.ferret50.com, then email a link to your post to info@ferret50.com and you will be entered once into the Giveaway. Use "Giveaway Entry" as the subject heading of your email and include your name, address, telephone number and email address for the entry to be valid.
d) Share or post a photograph, of your own or from our website, of the Ferret50 on social media or on a firearms related (or otherwise related) message forum or board, including a link to www.ferret50.com, then email a link to your post toinfo@ferret50.com and you will be entered once into the Giveaway. Use "Giveaway Entry" as the subject heading of your email and include your name, address, telephone number and email address for the entry to be valid.
"Giveaway Promotion" - Spider Firearms is proud to announce the "Fabulous Ferret50 50cal Giveaway". We are giving away one Supercomp Ferret50 Rifle to one lucky winner! You can enter to win this rifle in four ways: By placing an order with us, by referring a customer to us who places an order, by sharing or posting this "Giveaway Promotion" (with links) on your social media page or on a message forum and by manual entry. Please see the complete list of rules by going to our website www.ferret50.com and clicking the link "Fabulous Ferret50 50cal Giveaway".
Spamming, over posting and over sharing is prohibited. Your share or post must be active and publicly visible from the date of post/share though the remaining duration of the entry period and on the date of the drawing and verification of the winning entry. Your account on social media and/or message forum or board must be in good standing from the date of post/share though the remaining duration of the Giveaway entry period and on the date of the drawing and verification of the winning entry for your entry to remain valid. Advice from Sponsor: Please use common sense when posting and sharing to prevent your post or share from being removed and your account blocked or banned. Sponsor has no control, responsibility or remedy if action is taken against you for overuse or abuse of your privilege to post and share on social media, message forums and boards, thus losing your eligibility as an entrant in the Giveaway.
II. By purchase or the placing of an order. Each purchase at Spider Firearms or the placing of an order for product at Spider Firearms during the entry period of the Giveaway will be entered into the Giveaway once for every $200.00 of the purchase or order amount. All sales are final and we do not offer refunds on purchases or deposits.
III. By referral of a purchasing or ordering customer. If the customer making a purchase at Spider Firearms or placing an order at Spider Firearms, during the entry period of the Giveaway, mentions a referral, the referring person will be entered into the Giveaway once for every $200.00 of the purchase or order amount after the referring person contacts Spider Firearms. The referring person must express their desire to participate in the Giveaway and provide their name, address, telephone number, email address and the name of the customer they referred to Spider Firearms.
IV. By manual entry. Bring a 3" x 5" card with your name, address, telephone number and email address to - Spider Firearms 2005-B Murcott Dr, Saint Cloud, FL 34771 - to be entered once into the Giveaway.
All entries become the exclusive property of the Sponsor and will not be acknowledged or returned. Entries which are incomplete, incorrect, incomprehensible, not received or do not otherwise comply with these Official Giveaway Rules will not be entered into the Giveaway. All entries made by entry service, automatic means, by facsimile, overnight courier, or in any manner not specifically allowed under these Official Giveaway Rules will not be entered into the Giveaway and may result in disqualification from the Giveaway. You are not a winner until the winning entry has been validated, documents completed and Prize legally transferred to your possession.
5. Entry Period. The entry period shall be the availability of one manufacturing production beginning on December 12, 2015. When the manufacturing production that began in December 2015 has sold out the end of the entry period will be announced on www.ferret50.com 30 days before the conclusion of this Giveaway. Entries into the Giveaway will continue to be accepted during the 30 day announcement period. At the end of this 30 day announcement period the Giveaway will conclude by a random drawing of one (1) winner.
6. Prize Drawing. An announcement will be made on www.ferret50.com 30 days in advance of the date, time and location of the Giveaway drawing. At the announced time the Sponsor will draw by random selection one entry to be the winner of the Giveaway. The drawing will be open to the public. The Sponsor will within 48 hours verify the eligibility of the winning entry and make an attempt to contact the winner by phone, email and a written letter.
7. Prize and Odds of Winning. There is one (1) Prize to be awarded at the drawing of the Giveaway, a new Supercomp Ferret50 .50 Caliber Rifle. Odds of winning are determined by and depend upon the total number of eligible entries received. The odds of winning the Prize will be the same by any alternative means of entry. Winner will be solely responsible for all applicable taxes, and/or any other expenses associated with acceptance and use of the prize.
8. Claiming of Prize. The winner of the Giveaway will have 15 days to respond to the Sponsor with an affidavit to confirm eligibility, intent to receive the Prize, a liability and publicity release and the name, address, phone number and email of the receiving firearm dealer. The Prize must ship to a Federally Licensed firearm dealer who must produce a valid copy of their FFL. The Prize must be legally transferred by the dealer to the winner of the Giveaway only. The prize cannot be legally transferred by the receiving firearm dealer to a person other than the actual winner of the Giveaway. The cost of the Prize and shipping will be the responsibility of the Sponsor, any and all applicable taxes are the sole responsibility of the winner of the Giveaway. The winner agrees that all Federal and State laws will be complied with, without exception.
9. Failure to respond or ineligibility to receive the Prize. In the event that the winning entry is invalid, or the winner of the Giveaway does not respond to the Sponsor in the allotted time, or if the winner is ineligible to legally receive or possess the Prize, the entrant will be disqualified and a redrawing of the prize will be announced on www.ferret50.com to occur 30 days from the announcement of the redraw.
10. Winner Announcement. The winner of the Giveaway will be announced after the prize is awarded and received. By participating in the Giveaway you agree that your name and the state where the prize was shipped will be published on www.ferret50.com and in related promotional venues.
11. Privacy. Information collected during the Giveaway is subject to the Sponsor's privacy policy.
12. General Conditions. All applicable federal, state and local laws apply. The Sponsor is not responsible for: a) entries or electronic transmissions that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, mis-directed or non-delivered; b) any problems or technical malfunctions, omissions, interruptions, errors, deletions, defects, delays in transmissions, communication failures, denial of access by (but not limited to) websites, email servers, telephone systems and all other electronic and technical equipment, software, hardware and systems beyond the control of the Sponsor; c) damage to entrant's or any other person's computer; d) destruction or unauthorized access or alteration of entries; e) incorrect or inaccurate entry information whether caused by entrants or by any of the equipment or software or programming associated with or utilized in or by the Giveaway promotion; f) errors, deletions, tamperings, alterations, suspensions, blocking or bannings of any posts, shares, accounts or pages utilized in or by entrants; g) any error, failure, deletion, disqualification, damage, hardship, termination, suspension, costs that occur by human or any other cause in the administration, promotion, participation and conclusion of the Giveaway. If for any reason the Giveaway cannot be executed as planned, including but not limited to viruses, bugs, tampering, natural causes, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Giveaway, or if this Giveaway is compromised or becomes corrupted in any way, electronically or otherwise, the Sponsor reserves the right, in its sole discretion, to void suspect entries/entrants and/or modify, suspend and/or terminate the Giveaway. If the Giveaway is terminated before announcement and/or conclusion, the Sponsor will select a winner by random drawing among the remaining eligible entries. The Sponsor reserves the right, in its sole discretion, to disqualify any entrant/entry of any individual who tampers with or attempts to tamper with the entry process in any way, who attempts to enter by an automatic, automated or programmed entry method, who uses or attempts to use an entry service, who acts in a disruptive, inflammatory, derogatory, dishonorable, unsportsmanlike or unfair manner, who acts in violation of these Official Giveaway Rules.
13. Release and Limitations of Liability. By participating in the Giveaway, entrants agree to release, discharge and hold harmless Sponsor and associated parties from any and all liability, claims, loss, injuries or damages associated with participation in the Giveaway, or actions of any kind whatsoever arising out of this Giveaway, or the acceptance, possession, use or misuse of any Prize received in the Giveaway. By participating in the Giveaway, entrants waive all rights to claim punitive, indirect, incidental and consequential damages, attorney's fees or any other damages or costs.
14. Arbitration, Choice of Law and Jurisdiction. This Giveaway is offered only in the United States and is governed by the laws of the State of Florida. Except where prohibited by law, as a condition for participating in the Giveaway, entrants agree that any and all disputes and causes of action arising out of or connected with the Giveaway, or any Prizes awarded, shall be resolved individually, without resort to any form of class action lawsuit, and exclusively by final and binding arbitration. Judgment upon such arbitration may be entered into any court having jurisdiction. Under no circumstances will entrants and/or winner in the Giveaway be permitted to obtain awards for, and entrants waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorney's fees, and entrant and/or winner further waives all rights to have damages multiplied or increased. By entering, entrants irrevocably consent to the sole and exclusive jurisdiction of the district courts of the State of Florida located in the County of Osceola for any action, suit or proceeding arising out of or relating to the Giveaway.
